Terms of Service
These Terms of Service ("Terms") govern your use of the Habitever mobile application ("Habitever", "the app"), provided by Vishnu Viswanathan ("we", "our"). By downloading, installing, or using Habitever, you agree to these Terms. If you do not agree, do not use the app.
1. License grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Habitever on devices that you own or control, for personal, non-commercial purposes, subject to these Terms and the Google Play Store terms of service.
2. Restrictions
You agree not to:
- Copy, modify, reverse-engineer, decompile, or disassemble the app, or attempt to derive its source code, except to the extent such activity is expressly permitted by applicable law.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the app to any third party.
- Use the app to violate any law, infringe any third-party right, or transmit any harmful or illegal content.
- Circumvent or attempt to circumvent any feature gating, paywall, or licensing mechanism.
3. Premium subscriptions and purchases
Habitever offers optional premium features through an annual auto-renewing subscription and a one-time lifetime purchase. All purchases are processed by Google Play.
3.1 Free trial
The annual subscription includes a 7-day free trial for new customers. You will not be charged during the trial. If you do not cancel before the trial ends, the subscription will automatically begin and your Google Play payment method will be charged the applicable annual price.
3.2 Auto-renewal
Subscriptions renew automatically at the end of each annual term unless you cancel at least 24 hours before the renewal date. You can cancel at any time by opening the Google Play Store app, going to Subscriptions, selecting Habitever, and tapping Cancel. Cancellation takes effect at the end of the current billing period; premium features remain available until then.
3.3 Lifetime purchase
The lifetime upgrade is a one-time payment that grants access to premium features for the lifetime of the app on your Google Play account. It is not transferable and is non-refundable except as required by Google Play policy or applicable law.
3.4 Price changes
Prices and feature bundles may change. If the price of an existing subscription is increased, you will be notified through Google Play before the change takes effect, and you may cancel before the new price applies. We may run promotional pricing or regional pricing at our discretion.
3.5 Refunds
Refund requests are handled by Google Play in accordance with its refund policy. For requests outside Google Play's standard refund window, contact us at rsoc.dev@gmail.com and we will help where we reasonably can.
4. Your data
Habitever stores your habit data on your own device. We do not operate a server that holds your habit data. Optional Google Drive backups are stored in your own Drive account. See the Privacy Policy for full details on data handling.
You are responsible for backing up your data. While Habitever provides a backup feature, we are not responsible for data loss resulting from device failure, uninstallation, or your decision not to use the backup feature.
5. Health and well-being disclaimer
Habitever is a productivity and self-improvement tool. It is not a medical device, mental-health service, or substitute for professional advice. Do not rely on Habitever for medical, psychiatric, or therapeutic decisions. If you are struggling with your mental or physical health, please consult a qualified professional.
6. Acceptable use
You agree to use Habitever only for its intended purpose. You will not use the app in any manner that could damage, disable, overburden, or impair its functioning, or interfere with any other party's use of the app.
7. Intellectual property
Habitever, including its name, logo, design, source code, and all associated content, is the intellectual property of Vishnu Viswanathan and is protected by copyright, trademark, and other applicable laws. You receive only the limited license described in Section 1; no other rights are granted, whether expressly, by implication, or by estoppel.
8. Termination
You may stop using Habitever at any time by uninstalling the app. We may suspend or terminate your access to the app if you materially violate these Terms or engage in fraud, abuse, or any unlawful activity. Termination does not entitle you to a refund of any subscription fees already paid, except as required by applicable law.
9. Disclaimer of warranties
Habitever is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Vishnu Viswanathan be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, streaks, goodwill, or other intangible losses, arising out of or in connection with your use of Habitever. Our total aggregate liability for any claim arising out of or relating to these Terms or the app shall not exceed the amount you paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Vishnu Viswanathan from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the app.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of Habitever shall be subject to the exclusive jurisdiction of the courts located in India.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and surface a notice inside the app for material changes. Your continued use of Habitever after an update constitutes acceptance of the updated Terms.
